§1. Definitions

Order Form – the form on flor.wroclaw.pl through which the Buyer submits the data needed to fulfil an Order: contact details, delivery address, product size and quantity, and the email address for order confirmation. Consumer – a natural person placing or intending to place an Order for purposes not directly related to their business or professional activity. Buyer – a Consumer or Business Customer making or intending to make a purchase in the Store. Business Customer – a person placing an Order in connection with their own business or professional activity. Product – an item presented on the Store's website that may be the subject of an Order. Terms – this document together with its attachments. Online Store (Store, FLŌR) – the online platform available at flor.wroclaw.pl, enabling the Buyer to place Orders. Seller – Maria Komarnytska FLOR more than flowers, registered address ul. Legnicka 62a, 54-204 Wrocław, NIP: 8943214368, REGON: 525666474; contact details: phone +48 731 552 400, +48 794 552 400, email flor.flowerstore@gmail.com. Order – the Buyer's statement, submitted via the Order Form, expressing the intent to purchase a Product or conclude another contract through the Store.

§2. General provisions

1. Through flor.wroclaw.pl the Seller carries out retail sales of flowers and related decorative products by electronic means. 2. The Seller may change the list of available Products in the Store at any time without notice. This does not apply to Products covered by Orders already confirmed by the Seller. 3. Listing a Product on the Store's website does not constitute an offer within the meaning of the civil code. The Buyer submits an offer by clicking the "Order and pay" button. 4. Orders via flor.wroclaw.pl can be placed 24 hours a day, 7 days a week. 5. The User may contact the Seller by phone: +48 731 552 400, +48 794 552 400 or email: flor.flowerstore@gmail.com. 6. Before using the Store, the User is required to read these Terms. Reading and accepting the Terms is a condition for placing an Order. 7. The provisions of these Terms guarantee the User the rights arising from applicable law in the Republic of Poland. 8. Polish law applies to contracts concluded through the Store.

§3. Technical requirements

1. To use the Store, the Buyer needs a device with internet access and an active email address. 2. It is recommended to use the latest versions of Safari, Microsoft Edge, Google Chrome or Mozilla Firefox, with JavaScript and cookies enabled.

§4. Placing and fulfilling an order

1. To place an Order, the Buyer completes the Order Form (providing all required data) and accepts these Terms. 2. The Buyer is responsible for the accuracy of the data provided in the Order Form. If incomplete or inaccurate data is provided, the Seller is not liable for a failure to fulfil, or an incorrect fulfilment of, the Order. 3. The contract is concluded once the Order is placed and confirmed by the Seller. If no confirmation is received, please check the email address entered, or contact the Store directly. Order procedure: 1. The Buyer selects a Product using the "Add to cart" button. 2. The Buyer completes the Order Form and accepts the Terms. 3. The Buyer chooses a payment and delivery method and confirms the Order using the "Order and pay" button. 4. The Buyer pays using the chosen method. 5. The Seller verifies the payment and accepts the Order for fulfilment. 6. The Seller confirms the Order and payment to the Buyer. 7. The Seller fulfils the Order (delivery or pickup) and informs the Buyer accordingly. 4. The Order is fulfilled once payment is received by the Seller. 5. If an ordered Product is unavailable, or the fulfilment time is extended, the Seller will notify the Buyer no later than 3 days after the Order was placed. The Buyer may agree to the extended time, cancel the Product, or cancel the entire Order. 6. If fulfilment is impossible due to permanent unavailability of a Product, the Seller will notify the Buyer no later than 30 days after the Order was placed and refund the full amount received.

§5. Payments

1. Prices in the Store are stated in Polish złoty (PLN), are gross prices and include VAT. 2. At the Buyer's request, made when placing the Order, the Seller may issue a VAT-free invoice. The Buyer agrees to receive the invoice electronically without the recipient's signature. 3. Prices in the Store do not include delivery costs, which are borne by the Buyer. Exact delivery terms and costs are shown when placing an Order. 4. The Seller reserves the right to change Product prices, add new products, and introduce or withdraw promotions. This does not apply to Products already paid for by the Buyer. 5. Payment is made via Przelewy24: BLIK, payment card (Visa, Mastercard), Google Pay, Apple Pay, or online bank transfer. 6. For certain payment methods, the payment operator may charge an additional fee according to its own rates, for which the Seller is not responsible. 7. Orders not paid within the time allowed for the chosen payment method are automatically cancelled. 8. For certain Products, the Seller may restrict the available payment methods, which will be indicated on the product page.

§6. Delivery and pickup

1. Personal pickup is possible by prior arrangement at our shop addresses listed on the "Contact" page. 2. Courier delivery is carried out by couriers cooperating with the Seller. In justified cases, the Seller may also use other courier or transport companies. The delivery time is shown when placing the Order. The Seller is not liable for delays caused by the delivery provider. 3. Delivery costs are borne by the Buyer according to the current price list; the Buyer is informed of the cost when placing the Order. 4. The Seller states an estimated fulfilment time for each Product on the product page. 5. The delivery time is provided for information purposes, based on the carriers' offers; the Seller is not liable if a carrier fails to meet this time. 6. An Order containing Products with different fulfilment times is shipped once the entire Order is ready — according to the longest of the stated times. By agreement with the Buyer, parts of an Order may be shipped separately. 7. The Buyer undertakes to accept the shipped Product. 8. Upon receipt, it is recommended to check the contents in the courier's presence — matching the Order and checking for any transport damage. 9. In case of damage to a shipment, it is recommended to prepare a damage report in the courier's presence and notify the Seller. The absence of such a report does not exclude the handling of a complaint, but may make it harder to prove the damage occurred in transit.

§7. Right of withdrawal

1. Under Article 27 of the Polish Consumer Rights Act of 30 May 2014, the Consumer has the right to withdraw from a distance contract within 14 days, without giving a reason and without cost, subject to the exceptions below. 2. To exercise the right of withdrawal, the Consumer submits a statement — in writing to ul. Legnicka 62a, 54-204 Wrocław or electronically from the email address used when placing the Order, to flor.flowerstore@gmail.com. 3. A model withdrawal form is provided in §12 of these Terms. 4. Under Article 38 of the above Act, the right of withdrawal does not apply to: – perishable goods or goods with a short shelf life, in particular fresh flowers, bouquets and floral arrangements; – goods made to the Consumer's individual specification or intended to meet their individual needs. 5. Where the right of withdrawal applies, the Consumer returns the Product at their own expense and is liable for any decrease in its value resulting from use beyond what is necessary to establish the nature, characteristics and functioning of the Product. 6. Refunds are made no later than 14 days from the day the Seller receives the withdrawal statement, using the same payment method the Consumer used, unless the Consumer explicitly agrees otherwise. 7. The Seller may withhold the refund until the Product is received back, or proof of its return is provided. 8. If the Consumer chose a delivery method more expensive than the cheapest one offered, the Seller refunds the delivery cost only up to the amount of the cheapest option.

§8. Warranty and complaints

1. The Seller is liable to the Consumer for defects in the Product under the Polish Civil Code, taking into account the specific nature of the Products offered in the Store. 2. Where the Buyer is a Business Customer, the Seller's liability under warranty for defects is excluded. 3. Given the nature of the Products (fresh flowers, bouquets and arrangements) — natural, perishable goods — minor differences in appearance, colour, size or arrangement compared to the photos on the site do not constitute a defect. 4. Complaints regarding a Product should be reported promptly, no later than 24 hours after delivery. 5. A complaint can be submitted via the form on the "Returns & Complaints" page, by email to flor.flowerstore@gmail.com, or in writing to the Seller's address. 6. It is recommended to include details identifying the Order, a description of the defect and, where possible, photographic documentation. 7. The Seller reviews complaints promptly, no later than within 14 days of submission. A response is given in the same form the complaint was submitted, unless the Consumer indicates otherwise. 8. If a complaint is accepted, the Seller may, at its discretion: replace the Product, refund the full or partial value of the Order, or propose another solution agreed with the Consumer.

§9. Personal data protection

The Seller processes the Buyer's and User's personal data on the terms described in the Privacy Policy, available at flor.wroclaw.pl.

§10. Intellectual property

1. All content published on flor.wroclaw.pl is protected by copyright and belongs to the Seller. The Consumer is fully liable for any damage caused to the Seller resulting from the use of any content on the site without the Seller's consent. 2. Any use of the site's content elements without the Seller's express written consent constitutes an infringement of the Seller's copyright and may result in civil and criminal liability.

§11. Final provisions

1. If any provision of these Terms is found to be inconsistent with applicable law, the remaining provisions remain valid between the Parties. 2. The Seller does not consent to the use of its contact details (email, phone) listed in these Terms for purposes unrelated to placing and fulfilling an Order, in particular for direct marketing or unsolicited commercial communications. 3. Matters not regulated by these Terms are governed by the provisions of the Polish Civil Code. 4. The Seller may amend these Terms by publishing an updated version on the site. A change to the Terms does not affect Orders already paid for and confirmed, unless the change results from generally applicable law. 5.
